The English Bar Standards Board uses the criminal standard of proof in its
disciplinary hearings; “beyond a reasonable doubt”, “or satisfied, so as to be
sure”. It is now proposing to switch to the civil standard “on the balance of
probabilities” or “more likely than not”. This would bring it in line with other
professional regulators, including the Solicitors Regulation Authority and
the General Medical Council.
Have you ever had to write someone a reference? Well, there is a wellknown,
unwritten code for reference writing. You never say anything
adverse to the candidate. You just say nothing at all about the problematic
subject in question, such as the candidate’s ability in the chosen discipline.
If the reader of the letter understands how to read a reference, all will be
clear. If not, then they will get what they deserve.
The release of its signature song, “Light My Fire”, launched the U.S. rock
band The Doors from underground L.A. rockers into international superstars.
Guitarist Robby Krieger, the song’s lead writer, set out to write about

minutes and fifty-two seconds and, in the process, cutting out blazing guitar
solos. Despite the absence of those legendary licks, the trimmed-down track
was a smash hit. “Light My Fire” was the last song Jim Morrison ever performed
before his death on July 3, 1971.
The Conservative government in the United Kingdom triggered the drafting
of a consultation paper entitled “Reforming the Soft Tissue Injury
(Whiplash) Claims Process”. Its bold claim was that amounts awarded by the
court for minor whiplash claims were too high and that the best thing would
be to award no damages for pain, suffering and loss of amenities. As a fallback
position it proposed a tariff system with fixed awards for whiplash
injuries that lasted up to 24 months.
Recently the mayor of Los Angeles organized a one-day gun buyback. That
day the police collected 1,100 weapons. Those surrendering their assault
weapons received $200 gift cards, twice that amount for handguns. The pro-
