Based on this, the drivers argued they were eligible for overtime pay—backdated over several years. While the claim failed at first instance, the decision was overturned on appeal. The Court of Appeal reasoned that “the exemption’s scope is actually not so clear”. The drivers’ claim was allowed because “under Maine law, ambiguities in the state’s wage and hour laws must be construed liberally in order to accomplish their remedial purpose”, and as such the court adopted the drivers’ narrow reading of the exemption.
