Then Master (now Justice) Chamberlist described a plaintiff’s pleadings as having “gone through a metamorphosis”, with first an amendment substituting a plaintiff and “thereafter a further amendment which changed the plea of a written agreement being entered into between the parties to an agreement partly oral and partly written”: Goncalves v. Canadian Forest Products Ltd., 1997 CanLII 559 (B.C.S.C.). The cuts in legal aid in England have led to the increase of non-lawyers who assist litigants in person. These have become known as “McKenzie friends”. Since 2010 there have been specific rules governing the conduct of McKenzie friends and permitting such individuals to be paid for their services. The role of McKenzie friends was established in a divorce case, McKenzie v. McKenzie, 1970 3 All ER 1034. Levine McKenzie, who was petitioning for divorce, had his legal aid withdrawn. His solicitors sent the case to an Australian barrister, one Ian Hanger, who happened to be in London, but was not qualified to practise in England. Hanger hoped to sit with his client and prompt him, take notes and suggest questions for cross-examination. The trial judge ordered Hanger not to take part in the case (except to give advice during adjournments) and to sit in the public gallery. McKenzie lost and appealed. The Court of Appeal ruled that the judge’s intervention had deprived McKenzie of the assistance to which he was entitled and ordered a retrial. Just lately the Judicial Executive Board has proposed that McKenzie friends should be prohibited from charging for their services, on the ground that they are unregulated, uninsured and mostly unqualified. Hanger is now a Q.C. practising in Queensland. When the Titanic sank on April 12, 1912 there were nine dogs on board. Only two survived: a Pomeranian and a Pekinese. Henry Louis Mencken, an American journalist and commentator, wrote the following words in 1920 that have since been applied, successively, to George W. Bush, Barack Obama, and Donald J.
